US Initiates 337 Investigation on Chinese Synthetic Rubber Resins

Business News Agency June 25 The US International Trade Commission initiated a "337 investigation" on synthetic rubber resins and other products produced by companies in the Chinese mainland and the Hong Kong SAR on the 20th to determine if they have infringed intellectual property rights.

The US International Trade Commission issued a statement saying that the products involved are mainly synthetic rubber resins, including those used in tire manufacturing. The survey involved a total of 11 companies and individuals, most of whom have a Chinese background.

The so-called "337 investigation" was first named in the "United States Tariff Act of 1930" section 337, after undergoing several major amendments. According to this provision, the US International Trade Commission has the power to investigate complaints concerning patent and registered trademark infringements, as well as conduct investigations involving misappropriation of trade secrets, infringement of commodity packaging, imitation, and false advertising.

According to relevant procedures, the US International Trade Commission must, within a period of 45 days after starting the "337 investigation," determine the target time of the final award and complete the investigation as soon as possible. Usually the case needs to make a ruling within one year. If the company involved is found guilty of violating Article 337, the U.S. International Trade Commission will issue exclusion orders and prohibit imports of related products, which means that the products involved will completely lose their eligibility for entry into the U.S. market.
