Photovoltaic "quotas" allocation standard released

On August 5, the European Commission and the 18 member states of the European Union formally accepted the application for price commitment from the Chinese Chamber of Commerce and Industry and 94 photovoltaic companies. This price commitment will take effect on August 6, 2013. That is, from August 6th, 94 companies promised to export anti-dumping duties on the EU wafers, batteries, and components in accordance with the requirements of the price commitment agreement. Other companies that have not promised to export the above products to the EU will be levied with anti-dumping duties of 47.6% (non-commitment responding companies) or 67.9% (non-reported enterprises).

At the same time, the China Chamber of Commerce for Import and Export of Mechanical and Electrical Products issued the "Measures for the Implementation of Export Photovoltaic Battery Product Prices to the EU" on the same day. The Measures are organized by the Chinese Chamber of Commerce for the Import and Export of Mechanical and Electrical Products (hereinafter referred to as the Electromechanical Chamber of Commerce) to organize 94 independent photovoltaic battery product export enterprises (hereinafter referred to as enterprises) to be negotiated independently and applicable to enterprises and electromechanical chambers of commerce that participate in price commitments. It is understood that the China Chamber of Commerce for Import and Export of Machinery and Electronic Products will be responsible for organizing and coordinating the implementation of the price undertaking agreement, organizing the company's election price commitment work committee and price commitment supervision committee (hereinafter referred to as the work committee and supervision committee).

The work responsibilities of the working committee are to organize the enterprises to review the implementation methods, quantity distribution plans, and deployment opinions of the price commitments, and organize the implementation through the post-mechanism chamber of commerce; collect the opinions and suggestions of the enterprises, reflect the company's demands, and assist the electromechanical chamber of commerce to carry out industrial activities.

The supervisory committee's responsibilities are to supervise the price commitments and carry out related work and put forward relevant opinions; accept corporate complaints and reflect the company's appeals; and investigate and punish violations of companies, organized by the Electromechanical Chamber of Commerce.

The methods and criteria for the allocation of "quotas" have been clearly defined in the measures.

The mechanical and electrical product import and export chamber of commerce will be based on the principle of “fair, reasonable, transparent,” “who responds, who benefits, who responds more, and who benefits more”, determines the number of companies’ exports that year, formulates distribution plans, and submits all price commitments. The enterprise passed the deliberation. All involved products are implemented in accordance with this principle.

(1) The 60% share of the annual export volume as stipulated in the commitment agreement shall be allocated according to the share of the export PV module from the EU to the EU export module. Of which: 30% are calculated according to the EU's export share of the anti-dumping investigation period (July 1, 2011 to June 30, 2012), and 30% are calculated based on the export share from July 1, 2012 to March 31, 2013.

(2) To allocate 30% of the annual export volume stipulated in the commitment agreement as an encouragement and key support share to the participating industry defense enterprises.

(3) Priority will be given to supporting 10% of the annual export volume as stipulated in the commitment agreement to support smaller-scale export enterprises, and make up to 2MW for enterprises with an annual share of less than 2MW according to the terms; the rest will be used to support self-owned brands and technologies Photovoltaic cells with high content and good financial status are exported.

At the same time in accordance with the deployment mechanism. The electromechanical chamber of commerce analyzes and dynamically adjusts the number of companies assigned. On the basis of soliciting opinions from enterprises, the Electromechanical Chamber of Commerce proposes a deployment plan after summarizing, coordinating, and balancing the remaining number of enterprises and the number of applications for supplementation. The deployment plan will give priority to encouraging price commitments to complete better businesses.

The enterprise shall apply for the procedures according to the procedures stipulated in the price commitment agreement, and the Electrical and Mechanical Commerce Association shall issue a certificate of commitment for the enterprise that meets the requirements.

For enterprises that have one of the following behaviors, the Electrical and Mechanical Commerce Chamber may, depending on the circumstances, grant a moratorium on issuance of commitments, notify the supervisory committee at the same time, and suspend or stop the issuance of commitment certificates, reduce or cancel the export volume of the current year and the next Annual export quantity penalties.

(i) Declaring exports in a disguised form below the promised price.

(2) Providing statistical materials or other fraudulent acts of false reporting or malicious delay.

(3) The number of exports allocated by unauthorized transfer, reselling or disguised resale.

(4) Exports of unqualified products.

(5) The quantity of export cannot be returned in time if it is used up.

(6) Failing to participate in price commitment related activities for no reason.

(7) Violation of the commitment agreement or other provisions of the Measures.
